DUBAI // The man handed the death penalty for raping and killing an 8-year-old boy confessed to murder in his first hearing at Dubai Court of Appeal on Sunday.

Jordanian Nidal Eisah Abdullah Abu Ali confessed to drinking alcohol as well but denied kidnapping Obaida Al Aqrabawi in May from outside his Sharjah home and raping him.

The 48-year-old was sentenced to death on August 15 in a courtroom packed with people including about 10 members of the victim’s family.

After the sentencing, the Jordanian boy’s father said he will visit his son’s grave and tell him that justice had been served.

During the trial, the murderer claimed that he suffered from a mental illness but the court dismissed the claim as it was not backed up by any evidence.

Ali’s lawyer had submitted a plea to change the charge from premeditated murder to assault that lead to death but it was ruled that he had the intention to murder at the time, and this was proven to the court through documents and conclusive evidence.

The verdict read: “The court findings rest to the evidence in documents and to the confessions of the defendant, which came of his own free will and full awareness, and therefore [the court] rejects the defendant’s denial in the closing hearing and the pleas submitted by his lawyer and rules that Nidal Eisah Abdullah Abu Ali kidnapped and premeditatedly killed Obaida Ibrahim Al Aqrabawi after raping him.

“[The defendant also] consumed alcohol and drove his vehicle while under the influence of alcohol and, as for his request for a lenient sentence, the court stated that it was horrified by the defendant’s hideous crime and therefore unanimously sentenced him to death.”

Little Obaida was kidnapped on May 20 while playing outside his father’s garage in one of Sharjah’s industrial areas.

His body was found two days later in Academic City Road, in Al Warqa, Dubai.

The next hearing was not scheduled by the appeal court but it said a date would be announced later on Sunday.

Ali is not actually appealing his sentence, it is just standard procedure that any death sentence goes through the appeal court.
